Nebraska Executive Order 26-17, signed on 20 July 2026, directs state agencies to administer the ImagiNE Nebraska Act and the Nebraska Advantage Act consistent with their stated purposes, to consider environmental quality and statewide resource interests when reviewing incentive applications, and to form a Data Center Task Force that analyzes data centers' effects on water and the environment and makes recommendations to the Legislature in 2027.

On 5 June 2026 the Federal Energy Regulatory Commission accepted Southwest Power Pool tariff revisions, effective 1 July 2026, that add Conditional High Impact Large Load Service, a non-firm transmission service that can serve a large load such as a data center before long-term firm service is available, for up to seven years and subject to curtailment.
