Scope

California Public Utilities Commission Resolution E-5433 approves, with modifications, Pacific Gas and Electric Company Advice Letter 7667-E, an exceptional case submittal under PG&E Electric Rules 2, 15 and 16 for an agreement to energize a new 49 megawatt data center load for customer Menlo Equities (Sunnyvale Technology Partners LLC) in Sunnyvale through new transmission-level facilities. The Commission modified the refund of the customer's energization-related cost advances, limiting refunds to a share of net revenues received from the customer. Summary

On 19 March 2026 the California Public Utilities Commission adopted Resolution E-5433, approving with modifications PG&E's Advice Letter 7667-E for an agreement to energize a new 49 megawatt data center load in Sunnyvale at transmission level. The Commission limited refunds of the customer's up-front energization costs to a share of the net revenues PG&E receives from the customer. The resolution took effect the day it was adopted and applies to this one customer and project.

What this does not establish

  • This is a Commission resolution on one utility advice letter for one customer and project, not a statute or a general tariff.
  • The customer agreements and cost figures are not restated.
  • PG&E's later draft Resolution E-5455 (for another data center customer) describes this and two similar resolutions as approvals with modifications; no later Commission action modifying this resolution was found, but CPUC docket cards do not permit automated access.

Unresolved questions

None recorded.

Relationships

Supersession means a later instrument replaces the earlier legal effect. Repeal links identify the repeal instrument and the measure it ends. A later implementation or related letter is not treated as a replacement unless the record says so.
