Summary

West Virginia legislative rule 145 CSR 20 sets out how a petitioner applies to the Department of Commerce for certification of a microgrid district or certification as a high impact data center under the 2025 House Bill 2014 program. The final filing with the Secretary of State states the rule was authorized by House Bill 4983, was filed on 1 April 2026, took effect on 1 April 2026 and terminates on 1 August 2031. It sets eligibility and petition contents; it does not itself certify any project.

What this does not establish

  • An emergency version of the rule effective 22 December 2025 is listed on the Secretary of State rule page; it is not recorded separately.
  • The rule governs petitions and reporting; the tax and local-preemption consequences of certification come from the statute, not from this rule.
  • The list of certified projects was not opened.

Relationships

Supersession means a later instrument replaces the earlier legal effect. Repeal links identify the repeal instrument and the measure it ends. A later implementation or related letter is not treated as a replacement unless the record says so.
