Order letting ERCOT delay Batch Zero classification during the data-center audit

Enacted legislation or regulation

In effect This instrument is recorded as currently in effect as of the dataset date.

Scope

The commission's Order Granting Good Cause Exceptions in Project No. 59142 lets ERCOT delay classifying Large Loads for inclusion in Batch Zero past the 7 August 2026 deadline, include in the August and November 2026 quarterly stability assessments Large Loads submitted as base load that ERCOT has found eligible but not yet classified, and keep reviewing dynamic data after 7 August 2026 with a 24-day cure period. The order finds good cause to let ERCOT complete the verification and audit of data centers directed by the governor before continuing the Batch Zero process. It does not itself order a stop to energization.

Summary

On 20 August 2026 the Public Utility Commission of Texas granted ERCOT good-cause exceptions in Project No. 59142 so that ERCOT could delay classifying Large Loads for Batch Zero, include certain eligible but unclassified loads in the August and November 2026 stability assessments, and extend its review of dynamic data. The order states that good cause exists to let ERCOT complete the verification and audit of data centers directed by the governor on 3 August 2026 before continuing the Batch Zero process. It is a procedural implementation order for the ERCOT region.

What this does not establish

  • The exceptions apply to Large Loads of 75 MW or more generally; the order ties them to the governor-directed verification and audit of data centers.
  • The signature date on page 3 is not legible in the text layer. The adoption day is taken from the filing receipt (20 August 2026) and from ERCOT market notice M-A080326-02, which says the commission issued the order on 20 August 2026.
  • This order is not the ERCOT energization pause (record tx-ercot-interconnection-pause-20260803) and does not replace it.
  • The ERCOT power region is shown with a utility-territory scope and an ERCOT label, the closest scope available for a state regulator's order.

Unresolved questions

  • Whether the commission will grant further exceptions when ERCOT files its verification report (planned by 10 December 2026) was not established.

Relationships

Supersession means a later instrument replaces the earlier legal effect. Repeal links identify the repeal instrument and the measure it ends. A later implementation or related letter is not treated as a replacement unless the record says so.
