Scope

Act 21 of 2026 (Senate Bill 146) adds Fiscal Code Article XVIII-B, Subarticle B, sections 1811-B to 1816-B. Each data center of 10 megawatts or greater peak demand operating in Pennsylvania must file an annual report with the Department of Environmental Protection on its energy and water consumption for the preceding calendar year, with the first report due 1 July 2027. The Department publishes aggregate trends, and failure to report carries a civil penalty of $10,000 per day.
