Enterprise-zone limits for data centers

Scope

Oregon Laws 2026, chapter 50 (HB 4084) amends the enterprise zone statutes so that the exemption period may not be extended for qualified property used in operating a data center, and (Section 11b) provides that, notwithstanding any other law, an eligible business firm may not be authorized under ORS 285C.140 with respect to property consisting of a data center project before the date that is 90 days after the 2027 regular legislative session adjourns sine die. The act has other economic-development provisions that are not part of this record.

Summary

Oregon HB 4084, signed on 31 March 2026 and effective 5 June 2026 as chapter 50 of 2026, restricts enterprise-zone property tax benefits for data centers.
