PUCO interim SSO rules for AEP Ohio data center customers

Enacted legislation or regulation

In effect This instrument is recorded as currently in effect as of the dataset date.

Scope

In Case No. 26-113-EL-ATA, on Ohio Power Company's (AEP Ohio's) tariffs related to the standard service offer for data center load, the Public Utilities Commission of Ohio's Finding and Order entered on 5 August 2026 granted AEP Ohio's request for interim relief. Schedule DCT data center customers returning to the standard service offer (SSO) are subject to a 180-day advance notice requirement, AEP Ohio holds a separate procurement for that load, and the returning data center customer pays the full cost of that procurement. The Commission declined to extend the interim principles to customers not subject to Schedule DCT. The provisions apply until otherwise ordered by the Commission.

Summary

On 5 August 2026 the Public Utilities Commission of Ohio granted AEP Ohio interim relief for data center customers on its data center tariff (Schedule DCT) who return to the standard service offer. Such a customer must give 180 days' notice, AEP Ohio runs a separate power procurement for that load, and the data center customer bears the full procurement cost. AEP Ohio filed compliance tariff sheets effective 28 August 2026. The relief is temporary and applies until the Commission orders otherwise. The Commission’s current docket records a 30 September 2026 Entry on Rehearing denying the applications filed by Google LLC, Retail Energy Supply Association and Interstate Gas Supply, LLC. The entry’s operative text has not yet been reviewed here.

What this does not establish

  • Applications for rehearing were filed on 4 September 2026 by Interstate Gas Supply, the Retail Energy Supply Association and Google LLC, with memoranda contra on 14 September 2026. The docket record captured on 2 October 2026 lists a 30 September 2026 Entry on Rehearing (21 pages) in which the Commission denies those applications; the entry's own text has not been captured, so its reasoning and any conditions are not reviewed here.
  • The order says a procedural entry will be issued for a next phase of the proceeding. This record covers only the interim relief.
  • The 28 August 2026 effective date comes from the compliance tariff sheets (P.U.C.O. No. 22, Schedule DCT sheet footers), not from the order itself.
  • The Commission states that adopting the interim request is not an indicator of its long-term position on fair cost allocation for Schedule DCT customers.
  • The 2 October 2026 docket check supports the rehearing entry only; the earlier order capture has no readable text, so the 5 August 2026 order's own wording was not reverified. The interim procedures were reverified on Schedule DCT sheet 223-5 of the October 2026 tariff book captured on 3 October 2026; the September 2026 tariff book address answered HTTP 404 on 2 October 2026.

Unresolved questions

  • What the 30 September 2026 Entry on Rehearing says beyond denying the applications (its text is not captured), and whether any party seeks further review of it.
  • What the next phase of the proceeding will decide.

Relationships

Supersession means a later instrument replaces the earlier legal effect. Repeal links identify the repeal instrument and the measure it ends. A later implementation or related letter is not treated as a replacement unless the record says so.
