Scope

House Bill 5882 of 2026 would create the data center planning and responsibility act. It would allow a local unit of government, before imposing a moratorium on large-scale data centers or cryptocurrency mining facilities, to establish a task force, hold hearings or require impact studies, and would bar a local moratorium unless it is adopted by ordinance or resolution at a public meeting, states its scope, exemptions and a hardship appeal process, prohibits elected officials from entering into nondisclosure agreements about a proposed project, lasts no more than 6 months initially, and is the unit's first such moratorium. Large-scale data centers would be defined by thresholds the Public Service Commission sets.
