In effect This instrument is recorded as currently in effect as of the dataset date.

Summary

The Breckinridge County Fiscal Court adopted Ordinance 2025-1117A on second reading on 15 December 2025, by 5-2. It imposes a 365-day moratorium on the construction, development and operation of data centers and data storage facilities within the Fiscal Court's jurisdiction. County minutes of 17 August 2026 refer to it as the current moratorium, and posted minutes through 21 September 2026 show no extension or replacement. Its end date is unsettled: those minutes say 17 November 2026, while the ordinance's own terms point to about 15 December 2026.

Scope

Breckinridge County Ordinance 2025-1117A imposes a 365-day moratorium on the construction, development and operation of data centers of any size and all data storage facilities within the jurisdiction of the Breckinridge County Fiscal Court. The county says it has no planning and zoning while Cloverport, Hardinsburg and Irvington do, and the ordinance does not say whether it reaches inside those cities.

What this does not establish

  • The ordinance and the minutes are image-only scans, read by eye and by text recognition. On the ordinance, the day, the month and the last digit of the adoption year are handwritten.
  • County minutes for October 2026 were not posted when read on 3 November 2026, so a later change would not show here.
  • Minutes of 17 August 2026 say any extension would be based on a Kentucky Supreme Court decision on home rule and a solar farm ordinance. That decision was not read.

Unresolved questions

  • When the ordinance took effect, given its adoption and publication clauses.
  • Whether the moratorium ends on 17 November 2026 or about 15 December 2026, and whether the Fiscal Court extends it.
  • Whether it applies inside Cloverport, Hardinsburg and Irvington.

Relationships

Supersession means a later instrument replaces the earlier legal effect. Repeal links identify the repeal instrument and the measure it ends. A later implementation or related letter is not treated as a replacement unless the record says so.

  • No related action is recorded.
