Scope

K.S.A. 74-50,334, enacted by Laws 2025, chapter 124, section 4, requires the Secretary of Commerce, before awarding any public financial assistance or benefits to a qualified data center project, to seek and receive approval from the Fusion Center Oversight Board after the Kansas Intelligence Fusion Center evaluates the project's equipment and associated software for potential security threats to critical infrastructure; the board may approve the project, recommend or require changes, or deny it.

Summary

Kansas requires the Secretary of Commerce to obtain approval from the Fusion Center Oversight Board before awarding any public financial assistance or benefits, including the qualified data center sales tax exemption, to a qualified data center project.
