Scope

Act 851 of the 2023 Regular Session (House Bill 1799) adds a subchapter titled the Arkansas Data Centers Act of 2023. Its statement of intent includes recognising that data centers create jobs, pay taxes and provide economic value. Its operative text concerns digital asset mining businesses, defined as a group of computers working at a single site that consumes more than one megawatt on an average annual basis to generate digital assets. Among the limits it places on local governments, a local government shall not impose a different requirement for a digital asset mining business than is applicable to any requirement for a data center. The act prints APPROVED: 4/13/23.
