What the evidence establishes
Partly: borne out for LG&E; KU's tariff was not read. LG&E's Rate EHLF sheets, under the PSC's 16 February 2026 order, require a contract term of at least 15 years, billing demand of at least 80% of contract capacity, and collateral of 24 months of minimum bills, cut to 12 months only where the customer or guarantor is rated at least A and A2 and holds cash and equivalents of at least ten times the collateral.

Evidence

What the evidence supports

LG&E's tariff on file with the Commission, Rate EHLF (Original Sheets 26 to 26.2), is available only for new customers with a contract capacity greater than 50 MVA and an expected average monthly load factor above 85%. It says contracts 'shall be made for an Initial Contract Term of not less than fifteen (15) years'. Monthly billing demand for the Maximum Load Charge is the greater of measured loads or 80% of the contract capacity; energy is billed separately per kWh. Collateral is cash or a letter of credit equal to 24 months of minimum billed amounts at the largest contract capacity. It falls to 12 months of the annual minimum billed amounts only if the customer or its guarantor has an S&P credit rating of at least A and a Moody's rating of at least A2 and cash and cash equivalents on its audited balance sheet of at least ten times the collateral requirement. The sheets say they were issued by authority of the Commission's order of 16 February 2026 in Case 2025-00114, which approved the rate case settlement with modifications, including a 50 MVA threshold for Rate EHLF. These three terms are borne out for LG&E. The statement also covers KU, whose parallel tariff was not read, so that half is unverified. A tariff is not a bill.

Still unknown

Kentucky Utilities' parallel EHLF tariff was not read. Which customers have signed EHLF agreements and on what terms; agreements are to be filed with the Commission.
