Summary

The South Dakota Public Utilities Commission, acting under SDCL 49-34A-56, granted Leola Data Center, LLC's petition to take electric service from Montana-Dakota Utilities Co. for a proposed data center near MDU's Leola substation, a site inside FEM Electric Association's assigned service area. The Commission approved the parties' settlement, as amended, at its 8 September 2026 meeting, and the docket was closed on 11 September 2026. The order concerns one customer and site.

What this does not establish

  • This is a commission order for one customer and site, not a statute or a general data center tariff.
  • The day on which the written order was signed is not legible in the order's text layer; the docket lists the order under 09/11/26. The 8 September 2026 date is the meeting at which the Commission voted.
  • The settlement terms are incorporated by reference and were not restated here; the related electric service agreement under Rate 45 is a separate, pending docket (EL24-028).

Unresolved questions

None recorded.

Relationships

Supersession means a later instrument replaces the earlier legal effect. Repeal links identify the repeal instrument and the measure it ends. A later implementation or related letter is not treated as a replacement unless the record says so.
