Executive Order JML 26-058: ratepayer and community protection conditions for data center incentives

Scope

Executive Order JML 26-058 directs the Secretary of Louisiana Economic Development to develop and adopt a Ratepayer and Community Protection Framework for Large Load Investments that must be written into any agreement under R.S. 47:305.73(B) for the Data Center Sales and Use Tax Exemption and related incentives. Before a new data center is approved for, or continues to receive, those benefits, the project's demands on water, generation and transmission capacity, land and other resources must be evaluated against its benefits, and companies must file an attestation of their plan to meet the Framework. It does not change the statute and does not limit the Public Service Commission's jurisdiction.

Summary

On 25 June 2026 Governor Jeff Landry issued Executive Order JML 26-058, the Louisiana Ratepayer and Community Protection Initiative. It directs Louisiana Economic Development to develop a Ratepayer and Community Protection Framework that must be written as conditions into agreements for the Data Center Sales and Use Tax Exemption under R.S. 47:305.73(B) and related incentives for data centers and other large-load projects. The Framework's areas include large-load customers fully funding the generation, transmission and infrastructure needed to serve them, water and energy efficiency, local tax contributions, workforce and community investment, and transparency.   • The action type records the attestation and resource-evaluation conditions on an incentive; the order does not repeal or amend the exemption statute (record la-rs-47-305-73-data-center-sales-use-exemption).
  • The 90-day date for presenting the proposed Framework is a report deadline, not an expiration, and is not stored as a date.

Unresolved questions

  • Whether Louisiana Economic Development has adopted the Framework and applied it to any data center agreement was not established.

Relationships

Supersession means a later instrument replaces the earlier legal effect. Repeal links identify the repeal instrument and the measure it ends. A later implementation or related letter is not treated as a replacement unless the record says so.
