In effect This instrument is recorded as currently in effect as of the dataset date.

Scope

The Illinois Department of Commerce and Economic Opportunity states on its Data Center Investment program page that, under the Governor's directive of 5 June 2026, it no longer processes applications for the data center incentive program as of 1 July 2026. The statement concerns applications to the tax-incentive program under 20 ILCS 605/605-1025. Summary

The Illinois Department of Commerce and Economic Opportunity says that, under a directive the Governor gave on 5 June 2026, it no longer processes applications for the Data Center Investment incentive program as of 1 July 2026. The Governor's release of the same day says incentive agreements entered into before 1 July 2026 will be honored. No end date is stated. The statute creating the program, 20 ILCS 605/605-1025, remains in the compiled statutes and is a separate record.

What this does not establish

  • No separately signed directive was opened; the record rests on the Department's program page, with the Governor's 5 June 2026 release as a supporting source.
  • The Governor's release is published on the State of Illinois Newsroom, which is hosted on a third-party newsroom platform (prezly.com).
  • The Department page is undated; the page opened on 23 September 2026 differs in bytes from the 22 September copy but carries the same statement.
  • The pause does not amend or repeal section 605-1025 and does not say that existing certificates are cancelled.

Unresolved questions

  • Whether and when the Department will resume processing applications was not stated.

Relationships

Supersession means a later instrument replaces the earlier legal effect. Repeal links identify the repeal instrument and the measure it ends. A later implementation or related letter is not treated as a replacement unless the record says so.
