Scope

Senate Bill 353 (153rd General Assembly) would establish a moratorium on all applications and approvals for new data centers in Delaware, defined in the bill by a primary purpose of digital-data storage, management, processing or transmission, specified equipment, and use or ability to use 100 megawatts of power or more. During the moratorium no approval of, or permit for, construction of a data center could be granted by the State, a county, a municipality or another government agency, and the General Assembly would convene working groups, hold hearings and commission studies. The bill text says the act would expire on 31 January 2027 unless terminated or extended. It has not been enacted.
