Air quality permit for the co-located power plant has been formally appealed by Tucker United, the West Virginia Highlands Conservancy, and the Sierra Club; litigation over jurisdiction was ongoing as of an August 31, 2026 report (advocacy groups seeking WV Supreme Court review). A separate, distinct controversy concerns land ownership: the WV Department of Commerce reportedly found no property in Tucker County owned by Fundamental Data LLC or its affiliates, with permit-listed parcels instead owned by Western Pocahontas Properties, LTD, and large portions of the permit application redacted.

Proposed between the towns of Davis and Thomas, Tucker County. Reported acreage varies by source and is not recorded as a structured field: a 2024 purchase-and-sale agreement covered approximately 290 acres, other reporting describes a '500-acre' data center and power plant, a Country Roads News report describes a roughly 300-acre site, and West Virginia Highlands Conservancy describes 'potentially thousands of acres' for the full buildout -- these are not reconciled here.
