The Minnesota Court of Appeals ordered on 2026-06-08 that the City either obtain additional information on environmental impacts or require an EIS; on 2026-07-07 the City Council granted Archer an extension to 2027-03-31 to produce a supplemental EAW addressing water consumption, cooling technology, backup generation, emissions and operational noise.
