- What the evidence establishes
- Yes, within limits. A large load contract with a qualified electric utility must ensure all large load incremental costs are allocated to and paid by the customer, and the Public Service Commission must approve a contract when it finds the customer bears those costs and existing ratepayers do not. It covers requests expected to reach 100 MW within five years, under contracts for service to begin by 31 December 2034.

Evidence
What the evidence supports
The enrolled bill defines a large-scale service request as a request to a qualified electric utility for new service expected to reach a cumulative demand of 100 megawatts or greater within five years, or an increase of that size. It says a large load contract with a qualified electric utility shall 'ensure that all large load incremental costs are allocated to and paid by the large load customer', and repeats that rule for contracts with a large-scale generation provider using a connected system. A separate section says a large load customer 'shall pay all just and reasonable large load incremental costs' needed to receive service, including generation resources. The Commission must approve a submitted contract if, among other things, the customer bears all just and reasonable incremental costs and 'existing ratepayers do not bear costs justly and reasonably attributable to providing electric service for the large load customer'. Section 54-26-801 limits the chapter: its provisions apply only to large load customers, large-scale generation providers or qualified electric utilities that enter into a large load service contract providing for service to commence on or before 31 December 2034, and to private generation contracts with the same start-date limit. The bill took effect on 7 May 2025. It applies to large loads generally; it does not name data centers.
