Summary
The Town of DeWitt's published code shows Article XXIV, Moratorium on Data Centers, added on 8 June 2026 by Local Law No. 4-2026. While the moratorium lasts, town departments and boards may not accept, review or approve applications for data centers, defined as facilities capable of using 20 megawatts or more and designed or intended to be primarily engaged in data processing, storage, transport, web hosting or similar data services. The article runs from its effective date, which the code page does not print, through 31 December 2027 and may be extended twice by up to one year each. It is a temporary moratorium, not a permanent prohibition.
What this does not establish
- The source is the town code as published by its code publisher; the 8 June 2026 date is the date shown in the code history note, and the filed local law was not read.
- The code page does not print the effective date, so effect is not verified.
- The code page lists a later Local Law No. 6-2026 (a zoning amendment affecting Chapter 192) that was not read; whether it changes this article was not checked.
- The moratorium covers only facilities that meet both parts of the definition: capable of using 20 megawatts or more, and designed or intended to be primarily engaged in the listed data services.
Unresolved questions
- When Local Law No. 4-2026 took effect.
- Whether Local Law No. 6-2026 changes Article XXIV.
Relationships
Supersession means a later instrument replaces the earlier legal effect. Repeal links identify the repeal instrument and the measure it ends. A later implementation or related letter is not treated as a replacement unless the record says so.
- No related action is recorded.
