Summary

On 6 October 2026 the San Francisco Board of Supervisors passed File No. 261021, an urgency ordinance under Government Code Section 65858, by 11 ayes. The ordinance approves a citywide interim zoning moratorium under which the City shall not issue any approval or authorization for Data Centers, with exemptions for accessory data centers and for repair and maintenance that does not add size or capacity. Under Section 5 the ordinance takes effect on enactment, which occurs when the Mayor signs it, returns it unsigned or does not sign it within ten days, or when the Board overrides a Mayor's veto by a four-fifths vote. It lasts 45 days unless extended or replaced by permanent controls; the official copy leaves the Mayor approval date blank, so the effective day and the end of the 45 days are not stored.

What this does not establish

  • The official copy is the ordinance as passed on 6 October 2026; its Mayor approval date is blank and it records no veto override, so enactment and effect are not confirmed.
  • The 45-day term is counted from enactment, which the official copy does not date, so no end date is calculated.
  • Whether the Board extended the ordinance under Government Code Section 65858 was not checked.
  • The ordinance applies only in the City and County of San Francisco.

Unresolved questions

  • When the Mayor enacted the ordinance and so when it took effect and when the 45 days end.
  • Whether the Board of Supervisors extended the interim moratorium.

Relationships

Supersession means a later instrument replaces the earlier legal effect. Repeal links identify the repeal instrument and the measure it ends. A later implementation or related letter is not treated as a replacement unless the record says so.

  • No related action is recorded.
