Summary

On 15 September 2026 a majority of the Loudoun County Board of Supervisors voted for future consideration of a resolution that, if approved, would pause the Board's action on data center and electrical substation applications that require legislative approval for up to 12 months. The resolution was listed as agenda item 14p for the Board's 20 October 2026 meeting and was deferred to its 17 November 2026 meeting. The county releases reviewed show no adoption. As described, the resolution would pause Board votes only; it would not stop applications from being submitted or affect applications under administrative processes.

What this does not establish

  • The resolution text was not reviewed; its terms come from county news releases of 17 September and 20 October 2026.
  • The county's 17 September 2026 release says the Board indicated the resolution should be retroactive to 15 September 2026; that would apply only if the resolution is adopted.
  • The county releases state that the County Attorney's legal opinion found a moratorium on data center approvals is not legal; the proposed resolution is described instead as a pause on Board votes on legislative applications.

Unresolved questions

  • Whether the Board adopts, amends or rejects the resolution at or after its 17 November 2026 meeting, and whether an adopted version would apply from 15 September 2026.

Relationships

Supersession means a later instrument replaces the earlier legal effect. Repeal links identify the repeal instrument and the measure it ends. A later implementation or related letter is not treated as a replacement unless the record says so.

  • No related action is recorded.
