Scope

Manatee County Ordinance 26-42 establishes a temporary, 12-month moratorium under which, according to the county, it will stop accepting new applications for building permits, site plans, development orders, development agreements, special permit uses, rezonings and Comprehensive Plan amendments related to data centers, large-scale data centers and other large-load facilities in unincorporated Manatee County. The county states that the moratorium remains in place for 12 months or until repealed by the Board, whichever occurs first, and that the Board may extend it as permitted by law.

Summary

Manatee County announced on 8 October 2026 that its Board of County Commissioners adopted Ordinance 26-42 after the second and final public hearing. The ordinance places a temporary 12-month moratorium on accepting new applications for permits, site plans, development orders and agreements, special permit uses, rezonings and Comprehensive Plan amendments related to data centers and other large-load facilities in unincorporated Manatee County. The county says it is not a permanent prohibition and that it lasts 12 months or until earlier repeal, unless extended.

What this does not establish

  • The evidence is the county's press release dated 8 October 2026. The text of Ordinance 26-42 and the vote record were not opened.
  • The adoption day is taken from the release, which is dated Thursday, 8 October 2026 and says the Board adopted the ordinance after its final public hearing on Thursday.
  • No effective day is printed, so no end date is computed from the 12-month term.
  • The moratorium also covers other large-load facilities; the release does not define the covered facilities.
  • It applies only in unincorporated Manatee County.

Unresolved questions

  • The day Ordinance 26-42 took effect and the resulting end of the 12-month term are not stated in the county's release.
  • Whether the Board extends or repeals the moratorium before the 12 months run.

Relationships

Supersession means a later instrument replaces the earlier legal effect. Repeal links identify the repeal instrument and the measure it ends. A later implementation or related letter is not treated as a replacement unless the record says so.

  • No related action is recorded.
