Scope

Utah S.B. 318 (2026 General Session), Data Center Non Disclosure Amendments, would have barred state agencies, municipalities and counties from entering into non-disclosure agreements with a prospective data center (a proposed facility housing computer servers with a connected electrical load capacity of 20 megawatts or greater that has not received all approvals or is negotiating with the government), made such agreements void and unenforceable, and required public posting of agreements that violate it. The Senate struck its enacting clause and filed it on 6 March 2026; it did not become law.
