Scope

South Dakota Senate Bill 128 (2026), as introduced, would have required a large-use utility customer (established after 1 July 2026 with contracted electric demand of two thousand kilowatts or more) that operates as a data center to notify and cooperate with local water providers, use closed-loop cooling that limits net water withdrawal to amounts set by Water Management Board rule, and file quarterly water-use reports. It was amended in committee and deferred to the 41st legislative day on 18 February 2026.

Summary

South Dakota Senate Bill 128 of 2026 proposed water duties for large electricity customers operating as data centers, including closed-loop cooling, limits on water withdrawal and quarterly reports, along with changes to utility definitions. The Senate State Affairs Committee amended it and deferred it to the 41st legislative day on 18 February 2026.

What this does not establish

  • The record describes the bill as introduced; the index shows no later version was enacted.
  • A committee amendment was adopted before the bill ended; the amended text was not opened.
  • Deferral to the 41st legislative day, a day the session does not reach, is how South Dakota committees end a bill; the end date recorded here is that day.

Unresolved questions

None recorded.

Relationships

Supersession means a later instrument replaces the earlier legal effect. Repeal links identify the repeal instrument and the measure it ends. A later implementation or related letter is not treated as a replacement unless the record says so.

  • No related action is recorded.
