Scope

House Bill 120 of the 2026 Maryland session, "Moratorium on Construction of New Data Centers – Co–Location and Generation Contingency", would have added Real Property 14-134 providing that a person may not construct a data center in the State and that a unit of State or local government may not approve a proposal to construct one, with termination tied to later co-location and generation legislation. Summary

Maryland House Bill 120 of 2026 proposed a statewide moratorium on constructing new data centers and on state or local approval of such proposals. The official bill page shows its last action as a House committee hearing on 3 February 2026, and the 2026 session adjourned sine die on its 90th day, 13 April 2026, without the bill passing. It never took effect.

What this does not establish

  • The end date recorded here is the scheduled 90th-day sine die of the 2026 session from the General Assembly's session-dates document; the bill page records no separate failure action.
  • The Utility RELIEF Act (chapter 353) later added a narrower Real Property 14-134 limited to certain Baltimore City tax increment financing districts; that is a separate record.

Unresolved questions

None recorded.

Relationships

Supersession means a later instrument replaces the earlier legal effect. Repeal links identify the repeal instrument and the measure it ends. A later implementation or related letter is not treated as a replacement unless the record says so.

  • No related action is recorded.
