Scope

Senate Bill 4016 of the 104th Illinois General Assembly would amend the Environmental Protection Act, the Energy Efficient Building Act, the Illinois Power Agency Act, the Public Utilities Act and related statutes to set environmental, water and energy requirements for hyperscale data centers. According to the official synopsis these include cumulative impact assessments, public notice, community benefits agreements, a prohibition on nondisclosure agreements, water planning and quarterly water usage reporting, Water Impact Permits, and annual energy and water reporting to the Illinois Commerce Commission. It is a pending bill and has not been enacted.
