House Bill 26-1030 data center incentive program (did not pass)

Legislation introduced (any outcome)

Did not pass This measure did not pass.

Scope

Colorado House Bill 26-1030 would have created a data center development and incentive program operated by a new Colorado data center development authority in the Colorado office of economic development, allowing a 100% state sales and use tax exemption on qualified purchases for operators of certified data centers that made investment, job, labor, energy-efficiency, water and backup-power commitments. It also would have let a utility regulated by the Public Utilities Commission submit a targeted resource acquisition application to meet emerging large-load customer needs. The House Energy & Environment Committee postponed it indefinitely on 7 May 2026, and it did not become law.

Summary

Colorado House Bill 26-1030, the proposed Colorado Data Center Workforce, Clean Energy, Grid Modernization, and Consumer and Environmental Protection Act, would have created a certification program offering certified data center operators a 100% state sales and use tax exemption on qualified purchases, plus a utility process for acquiring resources for emerging large-load customers. The Legislature's official bill page shows the House Energy & Environment Committee postponed it indefinitely on 7 May 2026 by an 11-2 vote, and its status is Lost. It did not become law and creates no program or exemption.

What this does not establish

  • The quotes come from the official bill summary on the Legislature's bill page, which describes the bill as introduced; the bill text itself was not opened because the site's robots.txt disallows automated bill-text downloads.
  • The certification criteria, post-certification duties and utility financing provisions are not restated in detail.
  • It created no program, exemption or requirement.
